Acceptance of Terms

By accessing our website, making a reservation, or using any services provided by PlayOfCpim, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services. These terms constitute a legally binding agreement between you and PlayOfCpim B.V.

Restaurant Services

PlayOfCpim provides dining services at our restaurant location in Groningen. Our services include table reservations, food and beverage service, private dining, catering, and related hospitality services. We reserve the right to refuse service to anyone for any reason, including but not limited to violation of our dress code, disruptive behavior, or failure to comply with health and safety requirements.

Reservations and Bookings

Reservations can be made through our website, by phone, or email. All reservations are subject to availability and confirmation by PlayOfCpim. We reserve the right to cancel or modify reservations due to unforeseen circumstances, including but not limited to equipment failure, staff shortages, or force majeure events. Customers will be notified as soon as possible of any changes to confirmed reservations.

Cancellation Policy

Reservations can be cancelled or modified up to 24 hours before the scheduled time without penalty. Cancellations made less than 24 hours in advance may result in a cancellation fee. For large parties (8 or more guests) or private events, different cancellation terms may apply and will be specified at the time of booking. No-shows may be charged a fee equivalent to a set menu price per person.

Payment Terms

Payment for services is due at the time of service unless other arrangements have been made in advance. We accept cash, major credit cards, and debit cards. For private events and catering services, deposit payments may be required to secure bookings. All prices are inclusive of applicable taxes unless otherwise stated. Gratuities are at the discretion of the customer.

Customer Conduct

Customers are expected to behave respectfully towards staff and other guests. We maintain a smart casual dress code and reserve the right to refuse entry to inappropriately dressed guests. Smoking is prohibited inside the restaurant. Customers are responsible for any damage caused to restaurant property during their visit. Disruptive behavior may result in immediate removal from the premises.

Food Safety and Allergies

While we take precautions to accommodate dietary restrictions and allergies, we cannot guarantee that our food is completely free from allergens. Customers with severe allergies should inform us at the time of booking and again when ordering. PlayOfCpim cannot be held responsible for allergic reactions resulting from undisclosed dietary requirements or cross-contamination that may occur despite our best efforts.

Intellectual Property

All content on the PlayOfCpim website, including but not limited to text, graphics, logos, images, and software, is the property of PlayOfCpim B.V. or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without express written permission from PlayOfCpim. The PlayOfCpim name and logo are trademarks of PlayOfCpim B.V.

Privacy and Data Protection

Your privacy is important to us. The collection and use of personal information is governed by our Privacy Policy, which is incorporated by reference into these Terms of Service. By using our services, you consent to the collection and use of your information as described in our Privacy Policy. We comply with applicable data protection laws, including the General Data Protection Regulation (GDPR).

Limitation of Liability

To the maximum extent permitted by law, PlayOfCpim B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of our services. Our total liability for any claim arising out of or relating to these terms or our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

Force Majeure

PlayOfCpim shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, or public health emergencies. In such cases, we will make reasonable efforts to notify affected customers and provide alternative arrangements where possible.

Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including but not limited to breach of these Terms of Service. Upon termination, your right to use our services will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Changes to Terms

We reserve the right to modify or replace these Terms of Service at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of our services after any such changes constitutes acceptance of the new Terms of Service.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Netherlands. The European Union Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr for consumers who wish to resolve disputes online.

Severability

If any provision of these Terms of Service is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be replaced by a valid and enforceable provision that most closely matches the intent of the original provision.

Entire Agreement

These Terms of Service, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and PlayOfCpim B.V. regarding your use of our services, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding such subject matter.
